Standard Terms and Conditions
STANDARD TERMS & CONDITIONS - UPDATED FEBRUARY 2011
- 1. All transport is subject to the latest RHA standard terms and conditions which are available upon request.
- 2. Transport rates are subject to annual review and will be increased in line with our increase of operating costs.
- 3. On a quarterly basis the average price of fuel paid by Abbey Logistics Group Limited will form the basis of potential fuel surcharges. The current fuel surcharge mechanism is based on 1% increase in transport rates for every 3p increase in average price paid over and above the base rate. When your account is setup with Abbey Logistics Group Limited you will be advised of the base fuel price at that time.
- 4. All rates include an allowance of 2 hours to load and 2 hours to tip. After which, so long as Abbey Logistics Group Limited are not to blame, demurrage will be charged at £35.00 per hour thereafter (demurrage will only apply once you reach 3 hours - i.e. 1 hour demurrage charge minimum).
- 5. Any deliveries made on a Saturday will incur a Saturday delivery premium of £60.00.
- 6. Any deliveries made on a Sunday will incur a Sunday delivery premium of £80.00.
- 7. Any deliveries made on a UK Bank Holiday will incur a Bank Holiday delivery premium of £140.00.
- 8. In the event that a load is to be returned to the collection point whilst en-route to delivery destination for reasons not the fault of Abbey Logistics Group Limited, a charge of 67% of the outgoing delivery rate will be made.
- 9. Rates quoted are inclusive of cleaning charges unless agreed otherwise in writing.
- 10. All orders are accepted subject to availability but must be received in writing at least 48 hours prior to the loading time.
- 11. Payment terms are 30 days from invoice date. Abbey Logistics Group Limited reserve the right to charge interest at 4% above the base rate at Royal Bank of Scotland on any amounts not paid within 30 days of invoice date.
- 12. Unless requested otherwise, POD's will be sent with your weekly invoices for you to retain. Copies will not be held on file at Abbey Logistics Group Limited.
- 13. All prices quoted are subject to VAT at the current rate.
- 14. These conditions and the agreement of which they form part shall be construed in accordance with English Law and the Customer hereby submits to the jurisdiction of the English Courts.
- 15. In all cases, if agreements made in writing between Abbey Logistics Group Limited and the Customer, then those terms will take precedence over the standard terms and conditions above.
